This User Agreement (hereinafter referred to as the “Agreement”) governs the relationship between the owners of the TriSummit website (hereinafter referred to as the “Website”) (hereinafter referred to as the ‘Administration’) and individuals (hereinafter referred to as the “User”) who has duly registered on the Website in accordance with Section 2 of this Agreement.
Registration on the Website, password, security
In order to use the services of the Website, the User must complete the registration procedure, as a result of which a unique account will be created for the User.
Upon completion of the registration process, the User shall use the login (unique account name) and password chosen by the User to access the personalized part of the Site’s services. The User is responsible for the security of their login and password, as well as for everything that is done using the Site’s services under the User’s login and password. The User is obliged to immediately notify the Administration of any case of unauthorized (not permitted by the User) access to the Site’s services under the User’s login and password and/or any other security breach.
The following nicknames and avatars are not welcome on the site:
- Profanity;
- Use of Nazi symbols;
- Incitement of hatred on various grounds;
- Images directly or indirectly related to sexual acts or violence;
- Attempts to impersonate the administration or moderator;
- Promotion of alcohol and drugs.
Responsibilities of a registered User
When using the Site’s services, the User is obliged to comply with the provisions of current legislation and this Agreement.
The User is fully responsible for the information, data, text, programs, photographs, graphics, videos, messages, and other materials (hereinafter referred to as “Content”) uploaded, sent, transmitted, or otherwise made available through the Site’s services. The administration is not responsible for the Content posted on the Site by the User.
By registering on the Site, the User agrees not to use any of the Site’s services to transmit/post Content that violates applicable law.
The User undertakes:
a) not to upload to the Website or transmit through the Website’s services any Content containing materials prohibited by law from distribution, including, but not limited to, materials promoting pornography, the cult of violence and cruelty, pornographic or extremist materials;
b) when posting Content on the Website, to respect the rights of third parties, including the rights of authors and copyright holders of the relevant intellectual property;
c) when using the Website’s services, not to unjustifiably disparage anyone’s honor, dignity, or business reputation;
d) not to post on the Site or transmit through the Site’s services any Content containing advertising information;
e) not to disclose the personal data of third parties with the intention of impersonating another person or representative of an organization and/or community without sufficient rights to do so, including employees of the Site;
g) not to post on the Website or transmit via the Website’s services spam mailings;
h) not to use the Website to post/send Content containing viruses or other computer codes, files, or programs designed to disrupt, destroy, or limit the functionality of any computer or telecommunications equipment or programs, to gain unauthorized access, as well as serial numbers for commercial software products and programs for generating them, logins, passwords, and other means of gaining unauthorized access to paid resources on the Internet, as well as posting links to the above information;
i) not to use the Site to collect, store, and distribute the personal data of other persons;
j) not to interfere with the normal operation of the Site.
The User acknowledges that the Administration has the right, at its discretion, to refuse the User to post Content or to delete any Content posted on the Site’s services without notifying the User and without any explanation of the reasons. The User undertakes to independently assess all risks associated with the use of Content, including assessing the Content for compliance with applicable law.
The Administration has the right to request from the User documents confirming that the User has all the necessary rights to post any Content on the Site.
By agreeing to view 18+ materials, the User thereby confirms that they are at least 18 years of age.
The User acknowledges the Administration’s right to modify the Site, including changing or adding sections, changing the design, etc.
The User acknowledges the Administration’s right to display advertisements.
- Posts made by the User will become unavailable for deletion if the post rating is 30 or higher.
Intellectual property rights.
The copyright holder of the materials posted on the Website and the Website’s services is the Administration or the persons who provided and/or posted them. The User is not entitled to copy, reproduce, distribute, or otherwise use the text, photographic, or video materials of the Website for commercial purposes without entering into a corresponding written agreement with the Administration or the relevant copyright holder.
Disclaimer of warranties and liability
The User agrees that:
- The Administration does not guarantee the User that the services of the Site will meet the specific goals of the User.
- The Administration does not guarantee that the services of the Site will be provided continuously, quickly, reliably, and without errors, or that the results that may be obtained by the User will be accurate and reliable. The Administration reserves the right to close any of the Site’s services at any time.
The Administration is not liable:
- for any direct or indirect losses incurred due to the use or inability to use the Site’s services, unauthorized access to the User’s account;
- The Site may contain links to other Internet resources. The Administration is not responsible for the functionality of such links, the content of other resources, or the observance of third-party rights to intellectual property and means of individualization used on other resources. The Agreement may be amended by the Administration without any special notification to the User. The new version of the Agreement shall come into force from the moment it is posted on the Site, unless otherwise provided by the new version of the Agreement.
